The Media Question Amnesty Thread

They do have registered trademarks for some of their old logos, but not others.

Here is their trademark registration for the old LWT logo for example
trademarks.ipo.gov.uk

Looks like it's one they're keen to keep as it's been updated to their new address. That particular client ID also has active registrations for Yorkshire TV, Calender and Signed Stories.

A lot of their other trademarks have either been surrendered or are dead, including all these
trademarks.ipo.gov.uk

As for the original example..... Trademarking to stop people using it too 'pass off' their goods or services by pretending to be that company. In this case as the person is using it to provide video content so that could be a clear case of passing off. But they'd struggle. Firstly it's not really that much like the LWT logo, it doesn't even say LWT. Stripey writing isn't exactly uncommon, you see things similar everywhere.

The main hurdle that ITV would come across is that despite it still being an actively registed trademark it has to be used. After 5 years of not using it they can be revoked or challenged. It's been almost 30 years since that logo was used, and over 20 since they traded under that name. That makes any accusations of 'passing off' very easy to defend.

One thing to remember before you go and use the old Anglia and Central logos to your hearts content.... Trademarking is different to copyright. Copyright is automatic and doesn't need registering. The various logos belonging to the constituent parts of ITV Plc will still belong to ITV and use of the specific logos is still subject to copyright law

Incidently there's been a few cases recently of old radio station brands being brought back by community or online stations. As discussed elsewhere the other day there's now a station in Birmingham called BRMB, despite Bauer owning the station that was originally BRMB. That's an example of a trademark expiring, it's been about 15 years since they stopped using it

It does make me wonder why the LWT logo is still registered, Yorkshire and Calender I can understand. But why that one and not Anglia or Central?

As an aside the CTF logo was turned into a model and an ident (with the then current ITV logo in it
0. Which was won at auction in 1997 as someone wanted the display case. A horrible feeling it's been sold for scrap as a result. Unless anyone knows different, but it really was a work of art.

I’m guessing this is the model/ident to which Mike was referring…

Interesting to see the HTV trademark continued to be renewed by ITV until August 2020, long after the HTV brand had stopped being used in any form on-screen. Presumably it has something to do with the fact that ITV Wales & West Group Limited (formerly known as HTV Group Limited) was only dissolved as a limited company very recently, February 2023 in fact. Still, it makes you wonder why ITV decided to renew this particular trademark for so long - especially when compared to the other ITV companies (i.e. Central) which were all pretty much considered "dead" by the end of the 2000s.

As I said above the claim on a trademark, even if it's still registered, is essentially void if the owner isn't actually trading using it - it can be challenged by someone wanting to use it

So unless they were using it in some way, or intending to at some point, it was a wasted registration. But they last 10 years so possibly it was still registered from something in the past or renewed automatically by ITV

Indeed, here is a link to the item discussing the auction (and subsequent sale)

That's a thing of beauty, can't believe anyone would want to buy it just for the case then get rid of it.
