I'm not sure if presenters are, or were, governed by a different set of rules, but I know that actors cannot veto the release of, say, old Blake's 7 (or at least, the rules were changed many years ago to prevent them doing so).
Re the Mike Smith thing, I wonder if his estate informed the BBC that they didn't wish for the programmes to be repeated, and the BBC pulled them out of courtesy, rather than an actual legal right of veto?
But I'm not a 'legal' person so I might be talking absolute codswallop!
